MCA CoA urges HC to allow constitution amendment

The Committee of Administrators (CoA), appointed by the Bombay High Court for implementing the Justice Lodha Committee report as per the principal order passed by the Supreme Court in July 2016, has approached the court again to provide a guideline regaring the amendment of the Mumbai Cricket Association (MCA) constitution. The Supreme Court on July 5 had stated that they are in the process of finalising the constitution binding on the Board of Control for Cricket in India and had passed an interim order that, "no High Court shall entertain any prayer with regard to appointment of any Administrators herein, and no election shall be held herein after".


The Bombay HC had granted a three-month extension to the MCA CoA to amend the constitution and hold fresh elections which end on August 15. In their affidavit to the Bombay HC, the CoA on behalf of the chief executive CS Naik, has stated: "In the circumstances mentioned, it would be necessary and in the interest of justice that this Hon'ble Court be pleased to permit the CoA to hold a general body meeting of the members to amend the constitution in accordance with the rules after the Supreme Court finalises the constitution of BCCI, and also permitting the CoA to hold the Managing Committee elections in accordance as may be amended after the decision of the Hon'ble Supreme Court. I, therefore, humbly pray that the appropriate order may be passed in view of the changed circumstances."
