Karisma in her DV case has secured an ad-Interim Ex-parte orders for protection of Children from the court which means that kids can’t be removed from jurisdiction of Mumbai. “Her husband Sunjay Kapur cannot
the kids out from Mumbai,” said Karisma’s lawyer Sanjay Parab. He also added, this is because there have been threats to Karisma from the family. Parab said in the next hearing on March 17, he will renew the protection of the kids.
Apart from that Parab is also going to argue on residence protection order which is basically restraining the respondent (Sunjay) from dispossessing or in any other manner disturbing the possession of the aggrieved person from the shared household, whether or not the respondent has a legal or equitable interest in the shared household; also restraining the respondent from alienating or disposing of the shared household or encumbering the same and directing the respondent to secure same level of alternate accommodation for the aggrieved person as enjoyed by her in the shared household or to pay rent for the same, if the circumstances so require.
Parab also said, “The complaint has been filed for physical and mental harassment and cruelty. Sunjay has also been staying with another woman along with her child. Karisma has claimed for maintenance of Rs. 10 lakh per month for both kids under the Domestic Violence act. ”
