Uddhav-led Shiv Sena faction moves Delhi HC seeking quashing of EC order

The Uddhav Thackeray-led Shiv Sena faction on Monday moved the Delhi High Court seeking quashing of Election Commission's (EC) order on freezing party's name and election symbol, the PTI reported.


The petition, filed by Thackeray, has challenged EC's October 8 order, contending it was passed in complete violation of principles of natural justice and without granting any hearing to the parties.


The petition has arrayed EC and Maharashtra Chief Minister Eknathrao Sambhaji Shinde as parties


The Election Commission on Saturday evening had passed an interim order which bars both Uddhav Thackeray and Eknath Shinde's cam from using party's name and symbol.

As per the EC's interim order, both the Uddhav Thackeray and Eknath Shinde factions would not be able to use the party name and election symbol in the bypoll in Mumbai on November 3. The commission had also asked them to suggest by Monday three name choices for their groups, and also as many symbols.

The rival factions had approached the Election Commission after the split in the Shiv Sena ranks in June this year, with both sides claiming to be the 'real Shiv Sena'.

The bypoll to Andheri East Assembly seat in suburban Mumbai has been necessitated due to the death of incumbent Sena MLA Ramesh Latke.
