Raj Kundra’s petition dismissed by Bombay HC

The petition of businessman Raj Kundra, who has been arrested in the pornography case, was dismissed by the Bombay High Court. In his petition, Kundra had challenged the remand order of the magistrate court and sought his immediate release.


Kundra had filed the petition to the Bombay High Court stating that his arrest was illegal. Kundra had said in his petition that the Crime Branch’s property cell did not summon him under Section 41(A) of CrPC. He was arrested without summons.


However on July 19, after searching the office of Viaan Industries, the police issued summons to Kundra on the spot under Section 41 (A) of CrPC. Kundra refused to accept this summon. After this, the police arrested Kundra.


Kundra was arrested by the Crime Branch of the Mumbai Police on July 19 in the pornography racket case. Kundra is currently in judicial custody. He has been further sent to judicial custody till August 10. He faces various charges under provisions of the Indian Penal Code and IT Act.

Kundra’s petition was heard, after which the court’s decision was reserved. Finally on Saturday, the Bombay High Court dismissed Kundra and Ryan Thorpe’s applications, challenging magistrate court’s remand order and seeking release. The High Court in its order said, “There was nothing wrong in the magistrate court’s order when it remanded Raj Kundra to police custody on July 20.”
