The special CBI court, at the City Civil and Sessions court, will hear the prosecution arguments on the bail application of Sheena Bora murder case-accused Peter Mukerjea on Monday. The defense argued that going by the investigation carried out by the CBI, Peter had no role in the murder.

Though the grounds for his arrest had been explained to Peter, Desai argued if Indrani’s claim that she had informed Peter of the murder on the night of the incident was “sufficient to rope him”.

Desai went on to say that the statements, emails and messages can’t prove anything against Peter, and said that even Indrani’s driver, Shyam Rai, only spoke of Indrani and Sanjeev Khanna.

Desai told the court that when Indrani confessed the crime before Khar police, she did not mention Peter’s name until December 15, and said that her statement as co-accused was not admissible. The CBI, in its reply, said that there had been calls between Indrani and Peter on the day of the incident, to which Desai argued that since they were husband and wife, they might have spoken of other matters. He said, “According to the prosecution, Peter had knowledge about the crime but he did not agree with the crime. If he had agreed, that is conspiracy; knowledge is not. Not informing the police is an offence, but this offence amounts to one month in jail, which is bailable.”

Desai said that the conspiracy had been carried out by Indrani with the aid of her former husband. “He cannot be involved because he loves his son too much.”
