The court had last week clubbed two counter cases in the firing incident and had framed charges against 11 persons in the second case.
Additional Sessions Judge S Y Kulkarni observed that the two cases are different and it would pass its judgment in the case against Kadam on April 27 and would then start the trial in the second case.
On July 11, 1997 Kadam is alleged to have ordered indiscriminate firing on a Dalit mob protesting against the desecration of an Ambedkar statue at suburban Ramabai Nagar.
The firing left nearly 10 dead and over 25 injured. In November 1997, the state appointed a commission under Justice S D Gundewar to investigate the firing. It completed its inquiry by August 1998.
The report indicted Kadam for firing indiscriminately at the mob. Based on the report, the state sanctioned Kadam's prosecution in August 2001 and an FIR was lodged against him with the Pantnagar police station on August 30 that year.
During the trial, Kadam denied all wrongdoing and said it was necessary for him to open fire on the mob to control the situation.
