Mumbai: Woman to get Rs 37,000 for faulty wig, eight years on

Everyone has bad hair days, but a woman stuck with a wig she was not satisfied with, for eight years, has got some justice for it. A consumer court has asked a clinic to compensate the Kandivli-based woman Rs 37,000 for selling her the faulty wig. The woman had bought the wig for Rs 18,000 in 2008. The court asked the clinic to compensate her with Rs 17,000 for the wig, Rs 10,000 for mental agony and another Rs 10,000 for legal expenses.

On May 13, 2008, the complainant visited Berkowits Cosmetic & Skin Clinic, Khar, for a wig for herself. She chose the design and gave measurements for the same and paid Rs 18,000 for it. But when she received the wig, it was not like the one that she had selected, also it did not fit her properly. She refused to accept it, but a person from the clinic requested her to use it for few days and said if she still didn’t like it, they will replace it.

Tearing her hair out
She started using the wig but faced a lot of issues. She then went to the clinic again after three months and personnel there asked her to pay an extra Rs 5,000 to replace it. She paid Rs 1,000 in advance for it.

When the complainant went again to collect the new wig, she saw that they hadn’t given her a new wig, but had done some changes in the old one and returned it. She was shocked and told them to return her money. The clinic personnel refused to do so. She then filed a case with the Consumer Court and demanded Rs 19,000 as compensation.

The clinic personnel in their reply to the court, refuted the allegation and said that the lady accepted the wig, and she had no problem with it. They also said she came after two months to replace it and they also did this for her.

Judge MY Mankar and member SR Sanap, Consumer Disputes Redressal Forum, Mumbai Suburban District, observed that the different amounts received for the purchase and replacement of wig were not convincing. Also the clinic had not mentioned the purpose in the bill for asking for money for replacement of the wig. The Judge observed that there was deficiency in service and asked the clinic to return Rs 17,000 along with 10% interest on it from September 2008 and fined it Rs 10,000 for mental agony, and Rs 10,000 for legal expenses.
