Special MCOCA Court yesterday issued a production warrant against Chhota Rajan for his involvement in the J Dey murder case, ordering him to be present in the court on January 7.

The prosecution yesterday moved an application saying, “Tender adjournment with prayer to defer further hearing till wanted accused is arrested and brought before the court for joint trial.”

Special MCOCA Judge A L Pansare then passed an order stating, “Rajan be jointly tried along with arrested (other) accused. Rajan to remain present before the court on January 7, 2016. Issue production warrant against Rajan.”

Public Prosecutor Dilip Shah told mid-day, “Rajan will be tried under the IPC sections, as there is no sanction regarding MCOCA charges against him. On January 7, he will be brought to the court, charges will be framed against him and the trial will also be initiated on the same day.”

Crime Branch officials informed the court that CBI officials had collected the case papers from them and even got them translated as they were in Marathi. However, they are unaware whether the central investigating agency has commenced probe in the murder case yet.

The judge also asked Crime Branch whether they did any investigation after Rajan’s arrest, to which its officers said that the case was transferred to the CBI.

The judge then said, “But it doesn’t exclude you (from doing investigation). Mumbai police does there parallel investigation.”
