A court in Bhiwapur, near Nagpur, handed down the sentence to Sudhir Parve, the MLA from Umred, in connection with a 2005 case; principal secretary says a call on Parve’s disqualification will be taken after his appeal is decided
Sudhir Parve, a BJP legislator from Umred near Nagpur, was sentenced to two years in jail yesterday for assaulting a teacher in a zilla parishad school. Parve was granted bail and it was not clear whether the conviction would amount to immediate disqualification of the MLA in accordance with the Supreme Court’s July 2013 ruling.

The SC had ruled that elected representatives will lose their membership of Parliament or state assemblies immediately, under the Representation of the People Act, if they are convicted of an offence punishable with imprisonment of more than two years.
Public prosecutor Anil Bihaut said Parve was charged for assaulting Mahadev Zadgave, a teacher attached with a zilla parishad (ZP) school in Selodi in Umred tehsil in 2005. The MLA was then a ZP member. He was chargesheeted under Sections 332 (Voluntarily causing hurt to deter public servant from duty) and 353 (Assault or criminal force to deter public servant from discharge of his duty) of the IPC.
On Friday, Bhiwapur Judge Kamal Jaisinghani sentenced Parve for two years each under both the sections, with the jail terms running concurrently. Parve told mid-day that he was released on bail by the Bhiwapur court, and allowed to appeal before the higher court. “I don’t have any idea about the disqualification clause. I’m seeking legal advice.
I have decided to appeal before a higher court (he did not specify whether he would approach the district sessions court or the Bombay High Court), and I’m confident that I will get justice there.”
Asked about the possibility of Parve getting disqualified, Principal Secretary (State Legislature) Anant Kalse told mid-day that a decision could be taken on the course of action only after the MLA’s appeal is decided. “I have not received the (Bhiwapur) court judgment yet. But I think the court has suspended his conviction and sentence till the appeal is decided,” he said.
