BJP leader and Union Minister Piyush Goyal expressed strong confidence in the ruling Mahayuti alliance's chances of securing a massive victory in the upcoming Maharashtra Assembly elections and claimed that opposition Maha Vikas Aghadi (MVA) had resorted to divisive politics, reported the ANI. Goyal, while campaigning for BJP candidate Archana Patil Chakurkar on Wednesday, said, "After being troubled by the divisive politics of Sharad Pawar and the Congress, it is now decided that Mahayuti will win. The reports are coming which indicate that Mahayuti will register a massive victory and a stable and strong government will be formed in Maharashtra," during his speech in Latur. Addressing the political scenario in Maharashtra, Goyal said that the difference between the MVA and Mahayuti in the recent Lok Sabha elections was of two lakh votes, stating that MVA's lead was narrow and based on a "fake narrative." "You can misguide people only once through your fake narratives. Sharad Pawar was in the centre for 10 years but he did not do anything for either the farmers or the Maratha. When the double-engine government of PM Narendra Modi and Mahayuti worked together, it benefited the farmers. Deshmukh family is running a politics of lies and dynastic in Latur," Goyal added. Archana Patil Chakurkar, is contesting against Congress MLA Amit Deshmukh, son of former Maharashtra Chief Minister Vilasrao Deshmukh, in Latur. Chakurkar is the daughter-in-law of former Lok Sabha Speaker and Congress leader Shivraj Patil, adding to the political weight of the contest. In the 2024 Lok Sabha elections, the MVA won 30 of the 48 seats in Maharashtra, while the Mahayuti secured only 17. However, Goyal remains optimistic about reversing this trend in the upcoming Assembly polls. Meanwhile, Union Home Minister Amit Shah earlier on Wednesday also expressed confidence in Mahayuti’s victory during a rally in Jalgaon, suggesting that the opposition will face a significant defeat. Shah remarked, "On 23, Aghadi's supra saaf hone wala hai, Mahayuti government will be formed. After the Lok Sabha's election Rahul (Gandhi) was really happy, and during Rajasthan elections they said that they will win, they will win, but when the results came out, then they were deflated. In Haryana, BJP government was formed. In Jharkhand there are elections going on, there too the BJP government will be formed." The Review Officer and Assistant Review Officer Preliminary Examinations are set for December 22 and 23. Demanding a rollback to the earlier practice of holding the tests on a single day, the students said they would not buckle down until their demand is met. Although the number of protesters was smaller compared to the previous two days, the students were firm on their stance. We will continue the agitation for one day, one exam, said Pratyush Singh, one of the protesting students outside the UPPSC office. One placard read, "We will not divide, we will not retreat, we will remain united until we get justice", another said, "One day, One examination". Gyanendra Kumar, a student, said, "Until our demands are met, we will continue the protest, whether it lasts for a week or many weeks. We are taking out a candle march against the adamant attitude of the commission." UPPSC Secretary Ashok Kumar told PTI on Tuesday that it was the commission's policy to designate only government educational institutions as examination centres, with each centre located within a 10-km radius of the district headquarters. Previously, when a paper was leaked, these same students demanded that private institutions should not be used as examination centres, Kumar said. Now, when the government has implemented guidelines based on their earlier demand, they are protesting against it. He added that out of 5,76,000 candidates registered for the PCS examination, examination centres are only available for 4,35,000 candidates across all 75 districts. Despite almost half of the 15,334 booths, where polling took place, being in the critical category, no Naxal violence was reported barring one of two incidents in which Maoists tried to prevent voters from reaching booths in West Singhbhum district but the attempts were thwarted by the police and administration, they said. "Approximately 66.18 per cent voter turnout was recorded as per data calculated till 9.50 pm, with Lohardaga district topping the list with 73.21 per cent polling and Hazaribag district recording the lowest at 62.78 per cent," a poll official said. The overall polling percentage in the state surpassed 63.9 per cent recorded in the 2019 assembly polls, according to the Election Commission. With this, the fate of 683 candidates, including former Congress MP Geeta Kora and Rajya Sabha MP Mahua Maji among 73 women nominees, in fray in the first phase has been sealed,. Barring Lohardaga and Hazaribag, the poll percentage in other districts were Seraikela-Kharsawan (76.02), Gumla (69.01), Simdega (68.74), Khunti (68.36), Garhwa (68.42), Latehar (67.16), West Singhbhum (66.87), Ramgarh (66.32), East Singhbhum (67.10), Chatra (64), Palamu (62.97), Koderma (62.15) and Ranchi (62.56).West Singhbhum, one of the most Maoist-affected districts in the state saw increase in voting. The executive cannot assume judicial powers to punish citizens by demolishing their properties without following due process, the apex court said while terming such excesses "high-handed and arbitrary" and ruling that they need to be dealt with the "heavy hand of the law". A bench of Justices B R Gavai and K V Viswanathan described as "chilling" the sight of a bulldozer demolishing a building, rendering women, children and aged persons homeless overnight. "If the executive acts as a judge and inflicts penalty of demolition on a citizen on the ground that he is an accused, it violates the principle of 'separation of powers'," the bench said in its 95-page judgment. "The chilling sight of a bulldozer demolishing a building, when authorities have failed to follow the basic principles of natural justice and have acted without adhering to the principle of due process, reminds one of a lawless state of affairs, where 'might was right'," it said. The bench said such high-handed and arbitrary actions have no place in the Constitution, which rests on the foundation of the rule of law. Passing a slew of directions, the bench made clear that they will not be applicable if there is an unauthorised structure in a public place such as road, street, footpath, abutting railway line or any river or water bodies and also in cases where there is an order for demolition made by a court of law. "No demolition should be carried out without a prior show cause notice returnable either in accordance with the time provided by the local municipal laws or within 15 days time from the date of service of such notice, whichever is later," the bench directed. The top court also observed that constitutional ethos and values would not permit any such abuse of power and such misadventures cannot be tolerated by the court of law. "The executive cannot become a judge and decide that a person accused is guilty and, therefore, punish him by demolishing his residential/commercial property/properties. Such an act of the executive would be transgressing its limits," the bench said. In order to allay the fears in the minds of citizens with regard to arbitrary exercise of power by the officials of the State, the top court finds it necessary to issue certain directions in exercise of power under Article 142 of the Constitution, it said. Article 142 empowers the apex court to pass any decree or order necessary for doing complete justice in any case or matter pending before it. Even after orders of demolition are passed, the bench said, the affected party needs to be given some time so as to challenge the order before an appropriate forum. And even in cases of persons who do not wish to contest the demolition order, sufficient time needs to be given to them to vacate and arrange their affairs, the apex court said. "Heavens would not fall on the authorities if they hold their hands for some period," the bench said. It directed that notice shall be served upon the owner/occupier by a registered post. Additionally, the notice shall also be affixed conspicuously on the outer portion of the structure in question. "The time of 15 days, stated herein above, shall start from the date of receipt of the said notice," it said. To prevent any allegation of backdating, the bench directed that as soon as the show cause notice is duly served, intimation shall be sent to the office of the concerned collector or district magistrate digitally by e-mail. "The collector/DM shall designate a nodal officer and also assign an e-mail address and communicate the same to all the municipal and other authorities in charge of building regulations and demolition within one month from today," it said. The notice shall contain details regarding the nature of unauthorised construction, specific violation and the grounds of demolition, it directed. The designated authority, the court added, shall give the person concerned an opportunity of personal hearing and pass a final order. It said the final order should contain the contentions of the 'noticee', and if the designated authority disagrees with the same, the reasons for it. The bench said the final order shall also contain why the extreme step of demolition is the only option available and other options like compounding and demolishing only part of the property are not available. It also said the proceedings of demolition shall be videographed. "Needless to state that the authorities hereinafter shall strictly comply with the aforesaid directions issued by us. It will also be informed that violation of any of the directions would lead to initiation of contempt proceedings in addition to the prosecution," the bench said. Justice Gavai, who penned the verdict, started his judgement with a few lines of famous Hindi poet Pradeep to highlight the importance of having a home. The oncologist, Dr Balaji Jagannathan, was stabbed multiple times by the son of the patient at Kalaignar Centenary Super Speciality Hospital on Wednesday morning allegedly over grievances regarding the treatment of his mother, according to hospital officials. The accused has been arrested and the doctor's condition is stated to be stable, the officials said. In a statement, the IMA said Jagannathan was stabbed seven times by the son of a patient who suffered from stage IV ovarian cancer. The doctor has been stabilised with great effort. He lost a considerable amount of blood since he was on anticoagulants, it said. "The medical profession of the country is stunned... (in) disbelief. No amount of superficial damage control exercises by governments is going to make doctors work without fear in this country. Strong deterrent legislations, exemplary punishments and proactive safety measures are required now and here," the IMA said. All governments have been put on notice with this heinous crime. The medical community of the country is deeply disturbed and is skeptical of the remedial measures, it said. "Only a comprehensive overhaul of the security atmosphere in hospitals could restore the confidence of doctors. The nation owes this to its doctors," the IMA said. After the attack, angry doctors and nurses protested in front of the entrance of Kalaignar Centenary Super Speciality Hospital and government doctors announced a strike. In the Sawantwadi constituency, rival Shiv Sena headed by Chief Minister Eknath Shinde, has fielded minister Deepak Kasarkar against Teli. The Eknath Shinde-led Shiv Sena is a constituent of the ruling Mahayuti with BJP and Ajit Pawar-led NCP as its allies. According to the PTI, Uddhav Thackeray also targeted Eknath Shinde, accusing him of blaming sea winds for the collapse of the statue of Chhatrapati Shivaji Maharaj at Raigad fort in the Malwan taluka of Sindhudurg district in August. "The Sindhudurg fort constructed by the warrior king has remained strong and sturdy braving sea winds for several centuries. People who blame sea winds for the collapse of Shivaji Maharaj's statue should be ashamed," Uddhav Thackeray said. The Shiv Sena (UBT) said when he became the CM in 2019, the first decision he took was to provide funds for the restoration of the Raigad fort and farm loan waiver, adding that Chhatrapati Shivaji Maharaj 'is not an EVM'. "Had my government not been toppled, I would have again waived farm loans. But the Mahayuti remembered women and farmers only after the Lok Sabha election," he said. Of the 48 seats in the state, the Mahayuti won only 17 in the Lok Sabha polls earlier this year. The Bal Thackeray-founded Shiv Sena vertically split in June 2022, resulting in the collapse of the Uddhav Thackeray government, after CM Shinde rebelled against the party leadership and aligned with the BJP to become the CM. Uddhav Thackeray lamented that the people of Konkan did not give the desired support to his party. "I appeal to you to put faith in the MVA so that Konkan can be led on the path of prosperity. Just like Mumbai is being given to the Adani group on a platter, the farmland and mines in Konkan can also be given to the group. We have to protect Konkan," he claimed, the news agency reported. 13 November,2024 06:04 PM IST | Sawantwadi | mid-day online correspondentA medical oncologist at the Kalaignar Centenary Super Speciality Hospital was stabbed multiple times on Wednesday by the son of a patient allegedly over grievances regarding the treatment of his mother at the same facility, a hospital official said. The man assaulted the doctor inside the outpatient room during a conversation regarding his mother's treatment. He was immediately apprehended by the hospital staff and handed over to the police, and he was arrested. The doctor is being treated, and he is stable, the official said. The attack led to an outrage and doctors and nurses gathered in front of the hospital entrance to mark their strong protest. "We do not have safety while doing our duty," one of the protesting KCSSH doctors said. Government doctors announced a strike and Health Minister Ma Subramanian is set to hold talks with them. Expressing shock, Chief Minister M K Stalin said the assailant had been arrested and that he had ordered a detailed probe. All steps will be taken to prevent the recurrence of such incidents in the future, the CM said. AIADMK chief Edappadi K Palaniswami said there was no security for a 'government doctor in a government hospital,' and it showed the status of the law and order situation. Palaniswami, the leader of the opposition, sought tough action against the culprit. BJP state unit chief K Annamalai blamed CM Stalin and the DMK regime over the incident. Deputy Chief Minister Udhayanidhi Stalin, alongwith Subramanian, inspected the hospital and assured stringent legal action. They met the oncologist, being treated at the ICU. Later, AIADMK leaders D Jayakumar and C Vijayabaskar also met the doctor under treatment. The hospital official said the assailant had been identified as Vignesh, a resident of a suburban neighbourhood and his mother Kanchana was the patient. The victim, Balaji Jagannathan, is a renowned oncologist and is serving as an associate professor in the medical oncology department in the hospital. Police Commissioner A Arun inspected the hospital and reviewed the security arrangements. He said a police outpost would be set up on the premises. Udhayanidhi said the assailant had been visiting the hospital for six months for treatment of his mother and there was no suspicion about him. The Deputy CM said, "For half an hour he (Vignesh) had discussed with the doctor. Based on what he was told in a private hospital, he had taken this decision out of anger. Stern legal action will be taken against him and steps will be taken to prevent recurrence." The official, an emergency medicine anesthesiologist, told reporters: "He closed the OP room (from inside) and stabbed the doctor in his neck, behind his ear, chest, forehead, on his back, head and stomach. There was huge blood loss. He is a heart patient and has undergone surgery for his heart ailment." Claiming that he wanted to talk about his mother, Vignesh entered the OP room and since the door was closed it could not be opened immediately and later with the help of security personnel, staff and others, the doctor was brought out. The oncologist, who had also undergone pacemaker implantation, was resuscitated and immediately operated upon by a multidisciplinary team of surgeons. The victim bled excessively and his medication for his heart ailment is the likely reason for more blood loss. Two units of blood were transfused and all wounds were sutured. "We have to wait and see for another six to eight hours for his recovery; the oncologist is under anaesthesia," the official added. The official said the assailant claimed that his mother was provided chemotherapy six times in the hospital. After shifting to a private hospital, they were told that her lungs were affected.
