A 56-year-old woman has been reprimanded by the court for meting out cruelty to her husband, complaining to his employers and blaming her husband for their lack of children.
As per the Bombay High Court, these acts amount to cruelty and quickly became grounds for divorce. The man a 62-year-old Goregaon resident was granted divorce by the court on these grounds as per reports by Hindustan Times.
A divisional bench said that the man’s wife had lodged a number of unsubstantiated complaints against him which caused a lot of trauma to the man, even led him to be arrested and jailed for eight days.
The bench said, “We are of the opinion that because of the unreasonable criminal proceedings initiated by the woman, her husband had to suffer tremendous mental agony and it was impossible for him to continue cohabiting with her.” They also added that the woman’s continuous complaints to his employers also jeopardized his career prospects.
The couple were married in 1972 and soon after they tied the knot, a number of differences cropped up. The woman allegedly filed a number of written complaints, both with the police and the man’s employer. On the basis of his wife’s complaints the man was prosecuted for various offences including the criminal cruelty under section 498A of the Indian Penal Code. He was later acquitted.
Apart from that the woman had also filed a petition for divorce in the Bandra court but never pursued it. In the year 2006, the man approached the family court asking for divorce. His petition was dismissed in 2010 after which he approached a higher court. The higher court then passed a judgment stating that he was indeed entitled to divorce and directed the family court to review the matter.
