Mid-Day Premium What’s missing in women’s safety plans in India?

Women's safety in India has been a major concern for decades. Despite various initiatives, and promises the country continues to see worrisome levels of gender-based violence. From the infamous 2012 Nirbhaya case to more recent cases like the Abhaya rape-murder case RG Kar rape-murder case and Badlapur school sexual assault, the issue has persisted. With repeated incidents of gendered violence, especially sexual violence, coming to the fore, it--yet again--raised concerns about the effectiveness of the government's action plans to protect women. As a reaction to the outrage and demands for justice over the Kolkata medic's case, the West Bengal assembly had unanimously passed the Aparajita Bill which called for harsher punishments for those who have committed sexual offences against women and children. Earlier we explored how effective this bill would be and in this report, mid-day spoke to experts who stated that the nation's approach to women's safety still has significant inadequacies. They suggested that there is still a large gap between policies on paper and their real-world execution.   The current state of women’s safety in India Women’s safety initiatives have gained more attention in recent years, with governments introducing schemes like the Nirbhaya Fund, setting up fast-track courts for sexual violence cases, and launching emergency helplines. While the government, through the Indian Penal Code and several Acts like POCSO, Criminal Law (Amendment) of 2013 and other legislations with the most recent being Bharatiya Nyay Sanhita, have introduced stringent laws against sexual violence. Speaking to mid-day.com, Mumbai-based activist Hasina Khan, said that while laws in India exist that deal with crimes against women, especially sexual violence, however, these bills have loopholes she said. "The laws were passed in a hurry with minimum interaction with the experts and thence they have loopholes. Particularly speaking about sexual violence, we should check the method of implementation of the bills," said the founder of the Bebaak Collective. Meanwhile, Akhil Neema, the co-founder of the Centre for Gender and Politics focusing on women's safety, said, "There are gaps in addressing safety in public spaces and for women in non-traditional work environments." He added, "While existing policies like the POSH Act have laid a foundation for addressing women's safety in workplaces, implementation remains a significant challenge. We've observed instances where companies seek POSH training certificates without conducting actual training, undermining the policy's effectiveness." What do records say? The National Crime Records Bureau (NCRB) data showed a steady rise in the total number of crimes against women in India over the last decade. In 2013, there were 2,23,652 cases reported, and by 2022, this figure had increased to 4,45,256. When focusing specifically on rape cases, the numbers have also seen a consistent increase. In 2013, 22,871 cases of rape were reported, and this number rose to 35,600 in 2022. The year 2021 saw the highest number of reported rapes, with 35,603 cases. Although there was a slight dip in 2020, the overall pattern remains one of concern. Speaking on Mumbai, the city saw 5,543 instances of rape get documented, with a steady increase reaching 7,456 by 2022. Although there was a modest decrease in 2020 to 7,023 cases, the overall trend has been one of constant growth. Similarly, in Maharashtra as a whole, the number of rape grew from 39,526 in 2013 to 58,796 by 2022. The numbers have risen considerably year after year, with 2020 indicating a slight decrease before continuing to rise in 2021 and 2022. Gaps in government policies Responding to a query on what her thoughts are on the implementation of laws concerning crimes against women, Hasina Khan said that the methodology of its implementation needs to be looked at. "For instance, the budget allocation and infrastructure recommended under the Protection of Women from Domestic Violence Act, 2005, has been in shambles for quite some now. Similarly, in regard to sexual harassment, a complaint can be filed within three months of the incident. Meanwhile, the implementation of the Internal Complaints Committee has not been uniform," she said. There's a need to examine how is the government utilising existing laws and infrastructure. "We lack budget, are inadequate to efficiently implement the existing laws. We don't need new bills that constantly talk about capital punishment for sexual assault," said Khan. It is crucial to examine how is the government dealing with gender-based violence and what is the state doing to deal with it, Khan added. Meanwhile, Adv Nausheen Yousuf, responding to the writer's queries said, "I believe a lot of times women need a support system at every stage, they need to know their case, interact with the prosecution so as to know the stage of it, psychological support etc. Though we have the law keeping up to it and even addresses victim compensation a lot more could be done here. The societal stigma is something at the ground level which we all are grappling with, the idea of "ideal victims" daunts every process." She further explained, "A lot needs to be done with sexual harassment at the workplace and domestic violence laws. Usually, people tend to undermine domestic violence, it's invisible, part of life, sadly "acceptable" and not taken as seriously as sexual violence. That's my major worry. Articles are written about sexual violence whereas domestic violence victims are forgotten. Though it's a more severe and intense and deep issue." When asked whether the laws--which deal with crimes against women--are inclusive or not, Khan said that she does not think present laws and policies are inclusive. "Politicians use women's issues as political tools for their advancement," said Khan and added that the women want quick redressal of their complaints, adequate infrastructure and others. "When the government provides us with all, that's when we'll be their ladki bahins," she quipped. Suggestions for improvement To fill the gaps in women’s safety plans, activists and experts have proposed several actionable steps that the government can consider. These suggestions focus on enhancing existing policies, improving enforcement, and fostering a cultural shift. "We believe our legislators can set an example by establishing clear legal protections for women in political spaces. This can be achieved by strengthening existing laws, such as explicitly including political parties under the POSH Act or creating specific legislation for this sector," Akhil Neema told mid-day. He further stated, "Additionally, it should be mandatory for all political parties to establish Internal Complaints Committees to address issues of harassment and discrimination. Improving data collection on gender-based violence and discrimination in political spaces is also essential to better understand the problem and implement effective solutions." Meanwhile, Naushen Yousuf stated that firstly it is crucial to provide awareness and "train officers to ensure they treat marginalised communities with fairness, rather than neglect". She further stated that building confidence within these communities to approach legal forums is essential. Speaking about the reforms the government can implement, she said and added, "Starting with our legislators, we must deny election seats to those facing accusations with pending cases. There should also be a support system at every level of the legal process." "Unfortunately, marginalised men often receive harsher punishments, such as the death penalty, while those from affluent backgrounds escape justice due to faulty investigations or misuse of evidence. Even when marginalised individuals are accused, the wealthy often have access to a fleet of lawyers, highlighting the disparity in legal support. The Nithari case is a clear example of this injustice, while cases like Asaram's reflect the slow legal processes. We need to critically examine and address these issues to ensure true justice for all," said Nausheen.

West Bengal: 40 students 'expelled' by state-run medical college

Forty students were "expelled" by the state-run College of Medicine and JNM Hospital in Kalyani for six months for allegedly threatening other pupils, according to an official document. The decision was taken at a meeting of the Extended College Council. "Based on large number of prima facie evidences, depositions by individual students and digital evidences, the Extended College Council decided to expel the following students from hostel, hospital and college campus for a period of SIX MONTHS at least (pending further investigations into to the allegations against them) starting from today (sic)," the minutes of the meeting said. These students would be allowed to enter the college, but not the hostel and hospital, only to appear in the examination, and to face a further enquiry by the Anti-Ragging Committee and Internal Complaint Committee or any special enquiry committee, it said. At the meeting, it was also unanimously decided to dissolve the Students' Welfare Committee till further notice or a democratically-elected students' body is formed, it added. None of the 40 students would be allowed to contest the students' body election, the minutes said. "The prevailing threat culture in College of Medicine & JNM Hospital, Kalyani must stop and should not be repeated ever again. Congress demands SPG security for Rahul and Priyanka Gandhi amid controversy

Cave-in near Delhi's Trilokpuri area creates 15-foot deep pit

A 15-foot-deep pit has been formed on a road in the Trilokpuri area of the national capital. Aam Aadmi Party MLA Rohit Kumar Mehraulia said that the pit may have been caved in due to heavy rain this year. "This incident happened around 9 pm...we informed the police, and they came here and placed barricades and stopped people from going there. Pune CA's death: Ajit Pawar expresses concern over EY employee's death

Maharashtra Deputy Chief Minister Ajit Pawar has raised the cases of "young people dying due to stress", referring to the death of a 26-year-old Ernst & Young employee in Pune, allegedly because of extreme work pressure. Pawar, who is the guardian minister of Pune, said in a post on X on Thursday that he was saddened to learn about the Pune CA's death of the EY employee "due to stress". "The rising cases of young people dying due to stress need our attention. I hope Ernst & Young India will take corrective steps," he said. Anna Sebastian Perayil, who passed her CA exams in 2023, worked at the EY Pune office for four months before she succumbed. Her mother this month wrote to EY India chairman Rajiv Memani flagging the "glorification" of overwork at the multinational consulting firm, reported PTI. The Ministry of Labour & Employment on Thursday said it is investigating the alleged "unsafe and exploitative work environment", reported PTI. The woman's father, Siby Joseph, spoke to the media on Thursday and said his daughter had to work through the night, till 12.30 am. "We advised her to quit, but she insisted that this stint would provide valuable professional exposure," he said, reported PTI. He said the issue of extreme work pressure was mentioned before the senior officials of the company, but no action was taken in Pune CA's death. After the matter went viral on social media, EY on Wednesday issued a statement saying it was deeply saddened by Anna Sebastian's tragic and untimely passing in July 2024. EY said it would continue to improve and provide a healthy workplace in its offices throughout the country. Probe is underway: Labour minister Mandaviya The Pune CA's death was being investigated, Union Labour and Employment Minister Mansukh Mandaviya said on Thursday. "Whether it is a white-collar job or any other job, worker or employee at any level... if a country's citizen dies, then we obviously feel sad about it. An investigation is underway in the matter and steps will be taken on the basis of the investigation," said the Union minister, reported PTI. He was speaking on the sidelines of a program organized under the 'Viksit Bharat Ambassador - Yuva Connect' initiative at SP College. "Deeply saddened by the tragic loss of Anna Sebastian Perayil. A thorough investigation into the allegations of an unsafe and exploitative work environment is underway. We are committed to ensuring justice & Labour Ministry has officially taken up the complaint," Union Minister of State Shobha Karandlaje said on X earlier in the day. (With inputs from PTI)

Congress questions PM's standing ahead of Maharashtra visit

As Prime Minister Narendra Modi is set to visit Wardha in Maharashtra, the Congress questioned Modi's standing between Mahatma Gandhi and Nathuram Godse, PTI reported. Jairam Ramesh, the Congress general secretary in charge of communications posted three questions to the prime minister on social media platform X as he heads to Wardha.  "What is the BJP doing to prevent farmer suicides? This heartbreaking figure has come from the state's Relief and Rehabilitation Minister, who reported that around 2,366 farmers died by suicide last year, between January and October, he said.  "The reasons are evident: 60% of districts faced drought conditions last year but no help arrived from the government. When crops were damaged by unseasonal rains in more than half of the state, farmers were extended loan waivers, but 6.56 lakh farmers were deprived of this relief due to software glitches," he said. According to PTI, Ramesh stated that the Congress has continuously promised farmers MSP in accordance with the Swaminathan Committee's recommendation, a farm loan waiver with a Permanent Commission established to carry it out smoothly, and the settlement of all crop insurance claims within 30 days in response to this state-sponsored callousness. He asked what is the Bharatiya Janata Party's vision to support the farmers of not only Maharashtra but also the whole of India.  He went on to say that the groundbreaking Forest Rights Act (FRA), passed by Congress in 2006, gave Adivasi and communities living near forests the legal authority to manage their own forests and to profit financially from the forest products they harvest. The BJP government, however, has obstructed the implementation of the FRA, depriving millions of Adivasis of its benefits, he alleged. Gandhian institutions across the country from the Akhil Bharat Sarva Seva Sangh in Varanasi to the Sabarmati Ashram in Gujarat have faced demolition and takeover by the RSS and its affiliates," he claimed. Affiliates of the Sarva Seva Sangh in Varanasi are currently on a 100-day fast to protest the Government's "bludgeoning of this hallowed institution", he said. Tirumala desecrated by YSRCP govt; sanitization work has started, says Naidu

N Chandrababu Naidu, the Chief Minister of Andhra Pradesh has alleged that the previous Yuvajana Shramika Rythu Congress Party (YSRCP) government had profaned Tirumala, the home to renowned Sri Venkateshwara Swamy temple, he also mentioned that the sanitisation process has already began, PTI reported. Naidu further claimed that poor-quality food was served to the Tirumala devotees by the Y S Jagan Mohan Reddy- led government in an attempt to both diminish the sacredness and offend its followers. "After finding the evidence that substandard ingredients were used to make prasadam (consecrated food), we will take stringent action against the people responsible for it," said Naidu in a press release, cited by PTI. According to PTI, His comments came on the sidelines of inaugurating the Anna Canteen at the secretariat, the canteen offers subsidised meals for low-income individuals. The Chief Minister claimed that the YSRCP government had completely desecrated the deity Sri Venkateswara Swamy, one of the most revered Gods among the Hindus. Meanwhile, IT Minister Nara Lokesh asserted that the YSRCP government was responsible for a decline in the quality of Tirupati laddu and "annadanam," which is freely provided to devotees of Tirumala. "Corruption was done unlike any other time before. As part of that, adulterated ghee was used. Immediately after the NDA government was formed, a new executive officer (EO) was appointed and all the powers were vested in the EO to sanitise the entire system to ensure that earlier irregularities do not recur," Lokesh told PTI reporters at Renigunta Airport. He stated that as part of that action, ghee, rice, and all vegetables were tested in accordance with Naidu's instructions to preserve quality, and that the EO particularly sent ghee samples to the NDDB lab, the findings of which were released today. "Very clearly it was established in the report that lard, beef fat and fish oil were there. If Chandrababu Naidu says something, he will back it up with evidence..." added Lokesh in his statement to PTI.

PM Modi to attend 'Vishwakarma' event in Maharashtra, all you need to know

Prime Minister Narendra Modi will visit Maharashtra on Friday to attend an event in Wardha marking the first anniversary of the 'PM Vishwakarma' scheme and lay the foundation stone of a textile park that will come up in Amravati, reported news agency PTI. During the 'Vishwakarma' event to be held in Wardha around 11.30 am, PM Modi will release certificates and loans to the beneficiaries of this scheme, an official release said. The central scheme was launched on September 17 last year to provide end-to-end support to artisans and craftspeople who work with their hands and tools. The PM will distribute credit under the scheme to 18 beneficiaries under 18 trades. As a tribute to their legacy and enduring contribution to society, he will release a commemorative stamp to mark one year of progress under the 'Vishwakarma' event, it said, reported PTI. PM Modi will lay the foundation stone of a 'PM Mega Integrated Textile Regions and Apparel (PM MITRA) Park' that will come up in Amravati. The 1,000-acre park is being developed by the Maharashtra Industrial Development Corporation (MIDC) as the state implementation agency. The central government has approved seven PM MITRA Parks for the textile industry. PM MITRA Parks are a major step forward in realising the vision of making India a global hub for textile manufacturing and exports. It will help in creating world-class industrial infrastructure that would attract large-scale investment including foreign direct investment (FDI) and encourage innovation and job creation within the sector, the release said, reported PTI. PM Modi will also launch the 'Acharya Chanakya Skill Development Centre' scheme of the Maharashtra government, it said, reported PTI. Skill development training centres will be established in renowned colleges across the state to provide training to persons between the age group of 15 to 45, enabling them to become self-reliant and access various employment opportunities. Around 1,50,000 youths across the state will receive free skill development training each year, it added, reported PTI. The PM will also launch 'Punyashlok Ahilyadevi Holkar Women Startup Scheme', under which early-stage support will be given to women-led startups in Maharashtra, reported PTI. Financial assistance of up to Rs 25 lakh will be provided under the scheme and 25 per cent of the total provisions under this scheme will be reserved for women from backward classes and economically weaker sections as specified by the government. Maharashtra: Four members of family found dead in Dhule

Four members of a family, including two children, were found dead in their house in the Pramod Nagar area of Dhule on Thursday, police said. The deceased were identified as agricultural fertilizer seller Praveen Mansingh Girase, his wife Geeta Praveen Girase, who worked as a teacher, and their two children, Mitesh Praveen Girase and Soham Praveen Girase. Their bodies were found in their house in the Pramod Nagar area of the Samarth Colony under the Deopur police station area in the Dhule district, police said. Police said that they must have died about three to four days ago, as a very foul smell was coming from the house. It is suspected that Praveen Girase died by hanging himself while his wife and two children died after consuming a poisonous substance. The reason why the family took this extreme step is not yet clear, police said. Despite being a prosperous family, this horrific incident has shocked the people of Dhule. A thorough investigation is on to find out whether it is a mass suicide or something else, police said. Girase's house was closed for the last four days. Police said that the woman who used to come for household work also went back twice, thinking that the family must have gone to their native village. When the people around did not hear any sound from the house even after four days, some people informed Praveen Girase's sister Sangeeta. Sangeeta reached Praveen's house on Thursday morning and opened the door with the help of people, Praveen's body was found hanging in a room of the house and the bodies of his wife and children were found lying on the ground. As soon as the information was received, the police administration also reached the spot immediately. The citizens of the surrounding area also rushed to the spot. Two groups clash during Eid-e-Milad procession in Nandurbar

At least seven police personnel were injured in stone pelting after two groups clashed during a Eid e Milad procession in Maharashtra's Nandurbar on Thursday, an official said. The incident took place at 3pm in Maliwada area and it started after slogans were raised against a particular community, he said. "Police deployed to maintain law and order were also pelted with stones. Two officers and five constables were injured. Force had to be used to disperse the mob, which also damaged vehicles. The Nandurbar Superintendent of Police's vehicle and an escort vehicle were damaged. Some vehicles were set on fire," he said. "A house was set on fire by the irate mob. It also tried to set ablaze LPG cylinders. Clashes also spread to Navnath Tekdi and Shahdulla Nagar. Tear gas shells were fired to disperse the mob. Additional force has been called from Dhule and neighbouring districts The situation is now under control," the official informed. Suspects are being detained and the process of registration of cases was underway, he said.
