The state housing department has set out to find an alternative to the consent and ownership clause of the Development Control Rules (DCR) related to redevelopment of old buildings and clusters. Chief Minister Devendra Fadnavis on Monday directed heads of the housing department, Slum Rehabilitation Authority (SRA), Maharashtra Housing and Area Development Authority (MHADA) to come up with an alternative to the consent and ownership clause under rules 33 (7) and 33 (9) of the Development Control Rules (DCR) related to redevelopment of old buildings and clusters. The changes must be made to DCR in a month.

Sources said the government is looking to explore possibilities of removing the consent clause and seeking mandatory approval of 70 per cent of tenants on the dilapidated buildings that have been served an eviction notice. In regard to cluster development, the government might consider allowing redevelopment when tenants have 70-80 per cent ownership of the area. The MHADA can purchase the share of remaining landlords by giving Ready Reckoner rates. “The CM wants departments to find alternatives to the clauses, or reduce them marginally,” said a senior official on condition of anonymity.
