BMC gives the owner, director seven days’ time to reply, failing which the unauthorised constructions will be taken down

The BMC sent a notice to Union Minister Narayan Rane’s bungalow Adhish in Juhu over unauthorised construction, on Friday. The civic body has given seven days’ time to reply to its notice with permission for construction, failing which the BMC will pull down the unauthorised structures at the owner’s risk and cost and the owner and developer may be prosecuted under section 475 A of the MMC Act which is punishable with imprisonment and fine.

As per the notice sent to the owner as well as the director of M/s Artline Properties Pvt Ltd, the BMC team found unauthorised changes on all floors, barring the 7th floor, of the 8-storey bungalow. Neelam Narayan Rane and Nilesh Narayan Rane are the directors of the firm.
The case started on February 17, after the Brihanmumbai Municipal Corporation sent a notice to the owner of Adhish under Section 68 of the Mumbai Municipal Corporation Act, 1888. The next day, a BMC team visited the place but returned within five minutes as no one from Rane’s family was present. The BMC again issued a notice and subsequently on February 21, officials spent nearly two hours at Adhish to inspect the bungalow over alleged illegalities.
After almost two weeks, on Friday, the designated officer with K West ward sent a notice under sections 351, 337/342 and 347 of Mumbai Municipal Corporation Act, 1988. The notice also mentions the unauthorised changes made to the plan approved on January 23, 2013. The assistant municipal commissioner of K West and deputy municipal commissioner of zone IV did not respond to calls.
