Sonu Sood’s plea for interim relief against BMC's demolition notice dismissed by Bombay High Court

BMC had lodged a complaint against Sonu Sood, alleging that he has converted a residential building in Juhu into a hotel without permission. The K-West ward of the BMC filed the complaint at Juhu Police Station.

The Bombay High Court on Thursday dismissed actor Sonu Sood's petition challenging Brihanmumbai Municipal Corporation (BMC) notice against the alleged illegal construction at his residence.


A single bench of Justice Prithviraj Chavan dismissed the actor’s petition seeking interim relief against the BMC notice. Justice Prithviraj Chavan said, "Law helps only those who are diligent."


Sood's lawyer Amogh Singh sought a time of 10 weeks to comply with the BMC notice in October last year, and requested the high court to direct the civic body to not initiate demolition action.


The court, however, refused and said the actor had ample opportunity in the past and if required, he could approach the civic body. "The ball is now in the office of the BMC...you (Sonu Sood) may approach them," Justice Chavan said.

"You (Sonu Sood) are too late. You had ample opportunity," the judge added.

The actor in his plea claimed he had not carried out any illegal or unauthorised construction in the building.

"The petitioner (Sonu Sood) has not made any changes in the building that warrants permission from the BMC. Only those changes that are allowed under the Maharashtra Regional and Town Planning (MRTP) Act have been done," Sood's advocate Amogh Singh had argued.

The civic body had lodged a complaint against Sonu Sood, alleging that he has converted a residential building in Juhu into a hotel without permission. The K-West ward of the BMC filed the complaint at Juhu Police Station.

Vishwas Mote, assistant municipal commissioner of K- West ward, had confirmed that the complaint has been filed against Sood for alleged violation of the provisions of the Maharashtra Regional and Town Planning (MRTP) Act.

In the two-page complaint letter, the BMC alleged that the actor did not take any permission from the authorities before carrying out the structural changes in Shakti Sagar, a residential building on Juhu's AB Nair Road.

"It was found that accused Mr Sonu Sood and Mrs Sonali Sonu Sood have instituted/commenced/undertaken/carried out development or changed the user of land as detailed below: Unauthorised addition/alteration beyond approved plans and unauthorised change of user from residential to residential hotel building without taking technical sanction from competent authority," the BMC said in its complaint.

As per the complaint, the BMC had issued a notice to Sood in October last year in this connection.

"The land was one again inspected on Monday and it was found that the accused had not complied with the requistitions and was continuing to carry out unauthorised development even after the notice was served to him," the BMC said in the complaint.

After receiving the notice from the BMC, the actor had approached the civil court, but failed to get relief following which he filed an appeal in the high court.

Sood, who is known for films like "Dabangg", "Jodha Akbar", and "Simmba'', came into spotlight for his work in helping migrants reach their homes during the lockdown.
