Malad tower: BMC tears down commercial space

Malad tower: BMC tears down commercial space

The work to demolish the illegal structure in D wing of Atharva Landmark tower in Malad East began on Wednesday

The civic body has started the demolition of illegal structures on the second floor of Atharva Landmark tower in Malad East, said officials. The developer deviated from his original plan of constructing parking space, and instead built offices and shops. P-North ward officer Makrand Dagadkhair confirmed the demolition in the D wing of Atharva Landmark.



The BMC’s P-North ward started tearing down the illegal construction on Wednesday, after mid-day reported on January 31 how the builder cheated the homebuyers. The matter came to light after a Malad-based family, which booked six flats and seven parking spaces in the 22-storey tower 10 years ago, filed a complaint at Dindoshi police station last month. The complainant alleged that, as per the agreement, they were supposed to get the possession of flats in 2015. But they learnt that the developer built only 15 floors and sold two of their flats to someone else, and built commercial complexes in the floors allotted for parking.


The Atharva Landmark CHSL had also complained to the BMC against Shah, alleging unauthorised construction of 2,000 sq ft room in the underground parking area, and 2,600 sq ft rooms on the first and second floors where parking spaces were to be provided.

Police have booked the developer of Atharva Realtors, Deepak Shah, his partner Shrenik Jain, their manager Vikas Kumar and two others. "The developer had not obtained any permission from the BMC, and had allotted car parking to various members at the time of sale of flats by executing registered sale deed," said Atharva Landmark CHSL Secretary Kailash Yadav.
