Sooraj Pancholi on Jiah Khan case: Have a right to free, fair and expeditious trial

Actor Sooraj Pancholi has approached the Bombay High Court asking it to remove the stay on the trial in the Jiah Khan case, saying he has every right to face a ‘free, fair and expeditious trial’. The high court has stayed a lower court trial in July 2016.


“We have filed an intervention application in the petition filed by Jiah Khan’s mother Rabia Khan challenging the investigation of the CBI. We want to point to the court some facts that have been concealed by Jiah’s mother. My client has been facing fake charges for three and half years,” said counsel Prashant Patil.


Pancholi has also claimed that a British national, Desmond Bloom, had written to the Mumbai Police, as well as the CBI, that Jiah had once attempted suicide in London which has been purposely concealed by Rabia.

Patil may argue Pancholi is ready for trial but due to the six months stay, he is losing his right to a fair and expeditious trial in a lower court.

Jiah’s mother can always make an application under 319 of CrPc (Power to proceed against other persons appearing to be guilty of offence) in a lower court, they claim.

Jiah died on June 3, 2013, and the Sessions court is yet to frame charges in the matter, as the case has been stayed by the Bombay High Court.

Pancholi was booked for abetment to suicide, but Rabia has been alleging that it was murder and not suicide. Justice Ranjit More is likely to hear Pancholi’s application next week.
