The application filed by Mukerjea’s lawyer Kushal Mor states that Peter, according to his passport, is a British National and a senior citizen. He has also said that due to his old age he has been suffering from various ailments.
“Since last month Peter has been sleeping on the prison benches, which do not have any kind of cushioning and this has caused severe back and neck pain. The pain is sometimes so severe that he is unable to move,” said the application.
The application further says that it is his fundamental right to have basic things needed for survival inside the prison cell.
“The city has experienced its lowest temperature in many years during this winter and because of that sleeping on a cold, hard surface is causing severe back, neck, shoulder pain for Peter. This is further aggravating his illness and causing sleepless nights. He fears this pain will soon spread to other parts of his body causing stiffness in joints and practically rendering Peter immobile,” read the application.
Mor also filed an application seeking permission for Peter to be present in sessions court on January 30 for his bail plea hearing but it was rejected.
