Kapil Sharma vs BMC: Round one to stand-up comedian

It seems comedian Kapil Sharma has managed to give a ‘Babaji ka Thullu’ to the Brihanmumbai Municipal Corporation (BMC), after he was given some relief by the Bombay High Court, which on Monday stayed the civic body’s notice for alleged illegal construction in his flat in a Goregaon high-rise.

On April 28, the BMC had served a notice under 53 (1) of the Maharashtra Regional and Town Planning Act, 1966 for alleged irregular construction in Sharma’s ninth floor flat at DLH Enclave, New Link Road, Goregaon.

Sharma has claimed in the HC that the building DLH Enclave has been constructed as per the sanctioned plan, and the BMC has issued Occupation Certificate to it.

The comedian had prayed for a stay on the BMC notice till the matter is heard, which the court granted. Justices Ranjit More and Anuja Prabhudesai granted interim relief to Sharma till November 23 and will hear the matter further.

Trouble with the tweet
Trouble for the comedian started when he tweeted in August about corruption in the civic body, and the body started gathering evidence against his illegal activities in his office in Oshiwara, and residential flat in Goregaon. “I am paying 15 cr income tax from last 5 year n still i have to pay 5 lacs bribe to BMC office for making my office @narendramodi,” he had tweeted.

The Oshiwara police also registered a case against Sharma, actor Irrfan Khan, and builder Dev Land and Housing Private Ltd (DLH). The FIR was registered by BMC’s Sub-Engineer P South Ward Abhay Jagtap under section 53 (7) of the MRTP Act that deals with prosecuting flat owners for not complying with notices about unauthorised constructions.

BMC had found violations in 15 flats in the high-rise including unauthorized construction that was carried out in Sharma’s ninth floor flat. The BMC claims that the alterations were contrary to the full OC issued by P-South ward office in November 2013. Sharma has also been booked earlier for destroying mangroves and illegal construction near his bungalow in Versova.
