Kurla building issue: Denied possession, buyers drag builder to court

Irked with the builder denying them possession of their dream homes, 20 homebuyers have filed cases against the developer in the city civil court.

The aggrieved buyers had booked flats at Housing Development & Infrastructure Limited’s (HDIL) Premier Residences Kurla project, and were assured possession in December last year. But as the possession date neared, the builder called them to his office and demanded an additional sum for extra areas built.


The unexpected demand did not go down well with the buyers, as the developer wasn’t ready to give them anything in writing. “Twenty cases have been filed against the builder by various individuals, as he is still not ready to give us anything in writing. We are also planning to approach the Economic Offences Wing (EOW),” said Iqbal Mulani, who is awaiting possession of his flat.

Buyers said that the builder asked them for the additional payment after the civic body demanded the money. But, when MiD DAY inquired with the Brihanmumbai Municipal Corporation (BMC) officials, they denied making any monetary demands, stating they were unaware of the building project.

“Even the civic authorities have said they did not ask for any extra money, other than what they demanded the money for,” added Mulani. The homebuyers are also planning to stage a protest outside the builder’s Bandra office on March 1.
