In his order, Additional Sessions Judge V V Bambarde sentenced the sons to 3.5 years rigorous imprisonment and the father to nine months jail for the offence punishable under section 304 II and 149, rw 34 of the IPC.
Additional Public Prosecutor Buleshwar Hinge appearing for the prosecution told the court that the incident in question took place on October 31, 2012 at Khandupada road of Shanti Nagar locality in powerloom town of Bhiwandi. It was the result of a quarrel between the children over some petty issue which was raised by elders of both the families of the victim and the accused, the court was said.
The prosecutor pointed out that the accused, armed with all kinds of lethal and sharp weapons attacked the members of the victim's family in which one Habibulla Ansari (74) died and other received injuries, the court was told. Ansari received as many as 22 stab wounds over his body inflicted with sharp weapons by the accused.
The judge based on the evidence before him convicted the accused persons under section 304 II and sentenced them to varying jail terms. While the four sons, Imtiaz Ansari (28), Fiaz Ansari (34), Niaz Ansari (35) and Shakeel Ansari (40) were sentenced to 3.5 years of rigorous imprisonment, their father Nissar Ansari (72) was sentenced to 9 months of RI by the court.
Another accused from the same family who was also charged in the case-- Istiaque Ansari-- died during the pendency of the trial and hence the case was abetted against him.
