For the second time, on Thursday, Nationalist Congress Party leader Chhagan Bhujbal moved the sessions court for bail. His first bail application, which was filed on medical grounds, was rejected by the sessions as well as the high court.
Bhujbal in his application has said that schedule offences were included under the Prevention of Money Laundering Act (PMLA) on June 1, 2009, but the offence that he was alleged to have committed, happened on November 11, 2006.
The application further says, "The other accused who are alleged beneficiaries of the Sadan project, were never arrested. They were also permitted to furnish bail bonds."
Bhujbal has also mentioned that no interrogation had taken place since the time he was sent to judicial custody, and so there was no need to keep him behind bars. "The age of the applicant warrants consideration. Record says that he has been unwell during the entire duration of judicial custody," the application says.
