Underworld don Chhota Rajan, who had at first given his consent for a voice sample, later withdrew it, the Central Bureau of Investigation (CBI) informed the Special MCOCA court hearing the murder case of journalist J Dey. After the CBI informed the court of Rajan's withdrawal of consent, Judge Sameer Adkar asked his advocate Anshuman Sinha to file a reply to this.

Dey, who was Editor (Investigations) at mid-day, was shot dead in Powai on June 11, 2011, when he was heading home on his motorcycle. He was allegedly killed at the behest of Rajan.

The CBI also filed an application for access to an audio CD that contains a telephonic conversation between Rajan and another person, so they can use it for voice analysis. The CD is currently with the court. In addition, the investigating agency also sought to send Rajan's cell phone to the Central Forensic Science Laboratory in New Delhi, as it has not been tested yet. The matter will now be heard on February 11.

The prosecution sought a month's time to investigate and said they would expedite the probe but they also needed help from international agencies, since Rajan had spent years abroad.

Rajan's advocate filed application to meet him in the jail, while another accused, Nilesh Hedge, filed a bail application.
