A division bench headed by Chief Justice Mohit Shah said the PIL lacked any merit and a similar petition had been rejected by the Aurangabad bench of HC.

Patil claimed that he had approached the Election Commission of India as well as the Maharashtra home ministry and filed written complaints, but no action was taken.
The PIL had also nameed Union of India, chief election commissioner, president/secretary of Congress and chief secretary, Maharashtra home department as respondents.
