The Bombay High Court on Monday directed the CBI to hand over the statement of secret witness number 11 to former TV executive Peter Mukerjea, who has been arrested in the Sheena Bora murder case. However, the CBI was given permission to delete four to five lines, as those could reveal details of the agency's probe.
After a third chargesheet was filed on October 21, the CBI had referred to one more witness. The agency did not hand the statement of secret witness number 11 to the four accused - Indrani Mukerjea, Sanjeev Khanna, Indrani's driver Shyamvar Rai and her present husband Peter.
Peter's counsel Abad Ponda argued in HC before Justice Revati Mohite Dere, that the CBI had refused to give the statement using section 173 (6) of CrPC and citing some old judgments, but if it is to rely on any document for opening of its case under section 226, the accused had the right to it.
Additional Solicitor General, Anil Singh, appearing for the CBI, told the court that the case was still being probed from a financial point of view and several countries have been sent Letters Rogatory (LR) to get more details about financial aspects in it.
The statement will be handed to Peter by CBI special court Judge H S Mahajan on Tuesday.
