Mumbai: Trump Tower residents sue developers over free jet ride

Some residents of the upscale Trump Tower in Mumbai have taken their grievances to the Bombay High Court, alleging that the building's developers failed to provide the promised 10 hours of free flying time in India's finest private jet service. Macrotech Developers, formerly known as Lodha Group, are the developers behind Trump Tower Mumbai, a 75-storey ultra-luxury residential skyscraper.

"When we bought our flat in Trump Tower, the builder clearly stated in the agreement that we would receive 10 hours of free flying time on India's finest private jet service. On December 1, 2022, we reached out to the developer to inquire about this promise. They responded on February 28, 2023, stating that we could use the flying time through one ‘Plexus Aviation,' but we would need to cover landing and waiting fees. This additional cost was not mentioned in the agreement, and we believe it's unfair to be charged extra.

We paid above-market rates for our apartment based on the promise of exclusive amenities. A group of 25 residents has filed a case against the developer in the Bombay High Court. During the hearing, the builder's lawyer indicated they would seek a settlement. We are simply asking for the 10 hours of free flying time as promised, without extra charges, or a refund of Rs 40 lakh for each resident as compensation," stated petitioners Milaan Jhaveri and Dr H S Bhatia.

A media report indicates that the case was heard in court on Wednesday by Justice Arif Doctor. Senior Counsel Sharan Jagtiani, representing Macrotech Developers, informed the court that they would attempt to settle. The matter was also addressed again on Friday. The plea highlights a timeline of correspondence between the flat buyers and the company. It further notes that on December 1, 2022, flat owners sent an email to the developer requesting a R40 lakh refund, citing the lack of the promised 10 hours of free flying time.

"The facts stated in the article are incorrect. The private jet charter service has been available for several years now and many residents have used the same. Many others have approached us that they do not want to use the jet and hence, have asked us to give them a one-time compensation and those requests have also been accepted. A very small group of residents (less than 10 per cent) of Trump Tower Mumbai has raised this matter now and we will proceed as per law."
