The In a development in the assault case involving Mahim BJP leader Sanket âSunny' Sathe, Yogendra âAggy' Parke and Anirudha Gaud, the latter two say a charge of Attempt to Murder has not been levied against Sathe, despite the severity of the attack on them. They say the police has not booked Sathe under Section 307 of the Indian Penal Code for Attempt to Murder due to his connection with MLA Ashish Shelar, president of Mumbai's BJP unit.
Punishment under IPC section 307 can extend up to 10 years of imprisonment, and in case the victim is hurt, then maximum punishment can be extended to imprisonment for life. The Mahim police had arrested Sathe for allegedly assaulting Parke, Gaud and one other on May 10. Parke is currently undergoing treatment at Raheja Hospital; Anirudha has been discharged.
"Police saw that the victims were bleeding but they have not added Section 307," Parke and Gaud's lawyer said. The Mahim police responded saying Section 307 would be added after due process is followed. "Sunny Sathe allegedly beat up both victims with his hands, and then an iron rod," said a police officer. The Mahim police registered an FIR against the trio under Section 323 (Voluntarily causing hurt), 324 (Causing hurt by dangerous weapons), 326 (Voluntarily causing hurt by dangerous weapons) and 34 (Common intention).
