A local court acquitted a man accused of killing his wife on the ground of lack of evidence
Thane: A local court acquitted a man accused of killing his wife on the ground of lack of evidence.
District Principal Judge R R Gandhi in the judgement delivered recently acquitted Atul Narsi Gudka (42), accused of killing his wife Pragana (35) in a 2011 case observing that the prosecution failed to prove the case against the accused beyond reasonable doubt. According to the prosecution, Gudka strangulated his wife to death on March 11, 2013 at their residence in Narpoli of Bhiwandi.
Gudka was later booked under IPC section 302 (murder). The judge also observed that the prosecution had not examined any neighbour or family members of the deceased including her parents and children, who stayed with the couple.
The judge also observed that the investigating officer had very carelessly investigated the case and there was no seriousness found in the investigations and prosecution's entire case was based on circumstantial evidence and there was no eyewitness to the alleged incident.
