The Kurla magistrate court on Friday rejected the bail application moved by 35-year-old corporate lawyer Janhavi Gadkar for the second time. The advocate is accused of mowing down two persons on the Eastern Freeway in Mumbai on June 10 under the influence of alcohol.
Judge Richa Khedekar rejected the bail plea after hearing arguments of prosecution and defence.
Gadkar's lawyer, Mahesh Sabnis, argued before the court that the investigation in the case was over and hence she could be granted the relief.
He also said that the police have got various documents like blood report, RTO report, while all the injured victims have been discharged from the hospital.
She also told the court, through her lawyer Mahesh Sabnis, that she will cooperate with the police in the case.
However, the police opposed her bail application saying that the case is triable by the sessions court and, hence the magistrate's court cannot grant her bail. The police also contended that her bail was rejected at the previous instance by the same court on the ground that the offence was serious and the investigation was underway.
The prosecution told court, "The case is sessions trial case. The investigation has not been completed yet. We are also submitting the investigation papers to show the status of the case."
In the early hours of June 10, an Audi driven by Gadkar rammed into a taxi, resulting in the death of two persons, including the taxi driver on the Eastern Freeway. The deceased were identified as Mohammed Abdul Sayyad (55) and Mohammed Salim Sabuwala (50).
