Man gets three years in jail for groping minor in 2017

A special court on Tuesday sentenced a 25-year-old Mankhurd resident to three years of rigorous imprisonment for assaulting a minor on a crowded train in 2017. The accused, Mukesh Yadav, was also fined Rs 10,000, a Mumbai Mirror report read.

The bench headed by special judge BV Kale convicted Yadav under section 8 of POSCO Act and section 354 of the Indian Penal Code (IPC). According to a submission by public prosecutor Sulabha Joshi, the incident took place when the victim and her family were traveling between Thane and Mulund stations around 11 am. Yadav began to touch the minor inappropriately on her chest, and her private part. Due to the crowd, the girl was unable to move and out of discomfort, she told her father that Yadav had touched her inappropriately, the prosecution said.

Her father then raised an alarm, but Yadav managed to escape from the train which was arriving at Ghatkopar station. Her father and the passengers tried to grab him, but he escaped and ran towards the exit, the report added.

Yadav was noticed running on the platform by few RPF constables. They apprehended him and handed over him to the Kurla police who booked him under assault charges, the prosecutor said.

As there was no CCTV footage of the incident, Yadav was given a light sentence. The maximum sentence under section 8 of the POSCO Act is five years and/or a fine.
