The Mumbai Sessions court, on Wednesday, convicted a 45-year-old father for raping his minor daughter in a drunken state at his house in BKC, Bandra.
The special POCSO court judge Srishty Neelkanth convicted and sentenced the father to life imprisonment under section 376 (rape) along with relevant POCSO sections.
The 11-year-old daughter, in her statement to court, said the incident happened on March 8, 2013, when her mother had gone to work, her brother had gone out and her sister was out playing. When she asked her father whether she too can go to play, he refused to do so. The minor girl then started watching TV, but the cable went off so she went off to sleep. Her father, meanwhile, went out and came back in a drunken state.
The inebriated father came back, and raped his daughter. The girl started crying, and her wailing was heard by a neighbour. The neighbour knocked the door, and realised that the door was locked from inside. The girl ran and opened the door and informed about the incident to the neighbour. Her father ran away from the home. Even the neighbour in her statement said that she heard the girl crying and so she rushed to her, and saw the father leaving the place.
The mother, in her statement, said that her son came to her workplace and informed her that the father had done something wrong to his sister. The mother rushed home to see that the neighbour had already called police.
The police took the girl to the police station, recorded her statement and arrested the father on the same day.
The girl was with a child welfare community for twelve days, where she revealed that her father had done the same to her 2-3 times in the past, and when she informed her mother about it, she abused the father.
