Jiah Khan case: Prosecution seeks third adjournment in less than two months

A Special Women's Court yesterday deferred the opening of the Jiah Khan case trial to Thursday after the Special Public Prosecutor (SPP) informed the court that he was yet to receive documents pertaining to the case from the investigating agency. The SSP had sought adjournments on two previous occasions - January 19 and February 12.

SPP Dinesh Tiwari sought adjournment from Judge A S Shende claiming that despite promising him documents two days prior to the date of the case in the court, the investigating agency had failed to honour his written request. Tiwari sought adjournment after the Judge asked him to open the case based on the chargesheet and application filed by defence lawyer Prashant Patil.

Tiwari asked the court to adjourn the matter till February 29 so that he could prepare, to which Judge Shende said, "For the first time, I am seeing the prosecution delaying a trial."

Tiwari informed the court that he was under the impression that he would be getting the desired documents today (Monday) so that he could open the case on the next date. Citing the absence of investigating officer from CBI and Juhu cops, the judge observed, "Nobody wants to proceed with the trial."

On the other hand, Patil told court that the prosecution was willing to do submissions on the basis on murder offences. Here, Tiwari said, "Even Section 376 (rape) may come in this matter."
