Matter Of Facts

The applicant alleged that the ASJ S C Malik has used "abusive and unparliamentary words and statements" against him

Department of Law, Justice and Legislative affairs passed a complaint against an additional district and sessions judge (ASJ) of the Karkardooma court on alleged using abusive language, to the Delhi High Court.

After hearing the case of applicant Jhankar P Chaturvedi, Lieutenant Governor Tejendra Khanna's office forwarded the representation to the secretary, law and justice department of the Delhi government, who in turn forwarded it to the office of the registrar of the Delhi High Court for further action.

In the representation before the LG, Chaturvedi has alleged that the ASJ S C Malik has used "abusive and unparliamentary words and statements" against him, while granting bail to the accused in a case registered at the Gandhi Nagar police station.

The applicant is the brother of one late Alankar Chaturvedi, who was allegedly cheated by five people Ashok Bansal, Anil Bansal, Anurag Bansal, Brij Mohan Soni and Anil Saxena in connection with the sale of a plot on the Delhi-Jaipur highway. According to the representation, the accused sold the plot to Alankar, which belonged to people from SC and ST category and hence could not be sold.

The representation says that the accused sought anticipatory bail in the case after a FIR was filed with the Gandhi Nagar police station but it was rejected on December 12 last year.

As per the representation, the second bail application of the accused came up for hearing on April 22 this year.
Chaturvedi says that during the hearing, the additional sessions judge made unwarranted observations against him and his counsel and adjourned the hearing till April 25.

Registrar General of the Delhi High Court, Ajit Bharihoke was not available for comment.
